Workplace advisor didn't 'coerce' sacked employee to sign settlement

An employee has failed to prove that a workplace advisory service "threatened and coerced" her into settling her unfair dismissal claim on unfavourable terms.

Represented by advisory Employee Dismissals, the Erindale Jersey Stud employee's unfair dismissal application was listed for conciliation before the Fair Work Commission in August this year, and concluded with the parties allegedly agreeing that the employer would:

  • pay the employee seven weeks' wages ($8,078) less tax;
  • treat her dismissal as a resignation; and
  • provide her with a statement of service.

Two weeks later, the employee emailed the FWC seeking an extension on signing off on the settlement, saying she "felt pressured" into agreeing to the outcome that the Employee Dismissals representative had sought...
