'Wilful' D&A policy breach outweighed employer's 'flaw in moral judgement'

An employee's "severe error in judgement" in attending work while intoxicated outweighed his employer's "meaningful failure" to check on his welfare after sending him home, the Fair Work Commission has found.

Commissioner Paul Schneider said the employee's dismissal was procedurally sound, but he nonetheless highlighted that the employer had only seemed concerned about the employee leaving its premises and "exercised no care" to ensure his safety afterwards...
