Unvaccinated worker with "major health concerns" loses dismissal claim

An employee who refused to get vaccinated has failed to prove he was unfairly dismissed, with the Fair Work Commission describing his employer's process as "difficult to fault".

Following the Victorian Government's mandatory COVID-19 vaccination directions last year, Bulla Dairy Foods told its workforce that from 15 October, unvaccinated employees without an exemption would not be allowed to attend the workplace.

If this meant they were unable to perform the requirements of their role, it said their employment may be terminated.

To encourage workers to get vaccinated, the employer offered a cash incentive and arranged and paid for medical consultation with a doctor where necessary...
