"Unsupportive" employer fails to defend psych injury claim

An employee suffered a psychological injury as a result of two assaults and a perceived lack of employer support, and not because of reasonable disciplinary action, a commission has ruled.

The train guard was employed by the NSW Department of Transport from July 2019 until she became unable to work in August 2021. She has not returned to work since.

There was no dispute that she suffered from a psychological injury, however her employer argued she wasn't entitled to compensation because the injury was caused by its reasonable disciplinary action. The employee, on the other hand, claimed her injury arose from "bullying, victimisation, harassment [and] intimidation" by both management and members of the public...
