Underperforming manager fails to prove resignation was forced

An HR business partner has defended claims she failed to support an overwhelmed manager, with the Fair Work Commission finding she often acted as a "sounding-board" and tried to help improve her performance.

The former DMG Fine Wines marketing manager made a general protections application involving dismissal against the employer, its managing director and the HRBP, but they objected on the grounds she had resigned.

In proceedings to deal with the jurisdictional issue, the manager argued the employer had repudiated her employment contract, which amounted to a dismissal. Alternatively, she said she was forced to quit as a result of the MD and HRBP's conduct...
