Underperforming HR manager should have expected negative feedback

An HR manager has failed to prove a supervisor's conduct during a performance review breached her employment contract, with a court finding she should have expected some negative feedback.

In the July 2019 phone meeting, the Siemens Mobility HR manager was shocked by the regional head of HR's feedback, she claimed. Feeling distressed and upset, she immediately left work.

She took personal leave until October, but after her return the employment relationship continued to deteriorate, and the employer dismissed her in March 2020.

The HR manager subsequently sought damages for employment contract breaches, claiming the supervisor's conduct, and the employer's response to her complaints about it, didn't comply with the 'business conduct guidelines' that were incorporated into her contract...
