"This is your last day" comment undermines general protections objection

When a CEO asked an employee if she had another job to go to and then gave her an "opportunity to resign" before a negative performance review, she had no option but to quit, the Fair Work Commission found.

The Intellisoftware marketing manager had lodged a general protections claim involving dismissal, but the employer objected, claiming it didn't dismiss her and she resigned voluntarily.

The Commission heard evidence that in the lead up to her dismissal the employee had become increasingly frustrated with her manager's conduct.

A co-worker witnessed the employee becoming distressed when the manager spoke to her on the phone in an "aggressive tone", for example, prompting a complaint to the CEO...
