Swearing at colleague "under the guise of humour" constituted harassment: FWC

An employee's comments to a colleague "under the guise of humour" went "far beyond simply swearing" and amounted to s-xual harassment, the Fair Work Commission has ruled.

Lyndons sacked the sales representative in November last year for serious misconduct, after it found he had said to a colleague, "I will f-ck you up the arse" and "suck my dick", and on another occasion had approached the colleague from behind and "bear hugged" him.

Claiming unfair dismissal, the employee denied making the comments and said he had been unfairly targeted following an incident that prompted him to complain about his manager...
