An employer's "perseverance" with a proposal to reduce an employee's hours due to health and safety concerns forced her to quit, the Fair Work Commission has ruled in awarding her $29k in compensation.
Deputy President Peter O'Keeffe found the employer's failure to clearly inform the employee that it was engaging in consultation, and that it wouldn't change anything without her agreement, meant she believed it was unilaterally varying her full-time contract.
