Resignation was an "overreaction" to "sub-optimal" workplace interactions

An employee who claimed he was screamed at and bullied by managers has lost his constructive dismissal claim, with the Fair Work Commission ruling that his resignation was an "overreaction" to the circumstances.

Commissioner Christopher Platt found the employee had other options available to him, which he chose not to pursue, and rejected that he had "no effective or real choice but to resign".

The 63-year-old barman claimed that in January this year he was forced to leave his position with Open Door Pub Co, having been subjected to "workplace bullying, excessive micro-managing, screaming, having my complaints about being humiliated and bullied ignored, work and safety issues disregarded, [and] unpaid work"...
