Remote worker fairly disciplined for consuming alcohol "at work"

The Fair Work Commission has affirmed disciplinary action against a remote worker who drank wine during an online meeting, rejecting that he was not "at work" at the time.

In August 2021, while subjected to COVID-related work-from-home orders, the Lyneham Primary School teacher was in a meeting with his supervisor when he "picked up a cask of wine, lifted it above his head and opened the tap to drink from it".

The employer's investigation found his conduct was "inappropriate" and breached its code of conduct; it subsequently gave him a written reprimand and reduced his pay increment level for 12 months...
