Psych claim upheld over questionable bullying investigation

An employer was right to investigate bullying complaints against an employee, but it has failed to prove that it was reasonable to later add numerous other allegations for consideration, a commission has ruled in psychological injury proceedings.

The NSW Personal Injury Commission awarded the Mid North Coast Local Health District senior radiation therapist workers' compensation and medical expenses after finding that workplace issues caused his depressive disorder and aggravated a pre-existing mood disorder.

Commission Member Paul Sweeney said that the employer had failed to prove his psychological injury was caused by reasonable disciplinary action...
