Poor process undermined valid dismissal for "sarcastic" comments

An employee who made "sarcastic" comments about a colleague after she disclosed being s-xually harassed at work has won his unfair dismissal claim, due to his employer's "significant" procedural errors.

The St Marys Rugby League Club bar attendant, who was sacked in June last year, claimed the employer had no valid dismissal reasons, and that its HR practices were "abysmal" and denied him procedural fairness.

But the employer defended its decision, arguing the employee had engaged in "ongoing workplace conflict" with numerous female colleagues, and breached both its sexual harassment and bullying policies...
