Misconduct investigation didn't force worker to resign

An employer didn't constructively dismiss an employee when it offered her the choice of resigning, or returning to a workplace alongside her alleged bullies, the Fair Work Commission has found.

The Mind Australia support worker told her supervisor in May last year that her co-workers were harassing and targeting her.

A few months later, she asked to transfer to another work location after she learned her co-workers had complained about her behaviour towards them, and the employer temporarily moved her from its Laverton, Victoria mental health facility to its Williamstown site...
