"Long and considered resignation email" contradicts dismissal claim

An employee wasn't forced to resign by alleged discrimination, but rather she quit voluntarily because she felt "very aggrieved that she had not been promoted", the Fair Work Commission has ruled.

The Commission heard that in 2023, Burnett Mary Regional Group (BMRG) reduced the project manager's weekly hours from full-time to 16 at her request, because of her caring responsibilities as a single parent, but denied her request to work from home due to her mental health issues.

Shortly after, the employer decided to restructure its business, and created three new manager roles. It considered the employee's suitability for these, but decided she wouldn't be the right fit...
