Labelling misconduct as "criminal behaviour" was intimidation: FWC

An employee was inappropriately accused of "criminal" conduct then subjected to a procedurally deficient investigation, the Fair Work Commission has found in upholding her unfair dismissal claim.

The Coogee Legion Ex-Service Club manager was sacked in May this year for "theft", and for being dishonest during its investigation. She subsequently sought compensation for unfair dismissal.

The Commission heard that following a staff meeting on 18 April, the employer noticed some employees socialising at one of its bars and checked the CCTV footage to ensure they had paid for their drinks...
