"Inflexible" payroll system caused employee to think she'd been sacked

An absent employee thought she had been dismissed when she received a payslip referring to "termination payments", but this was an error driven by the employer's "inflexible payroll system", the Fair Work Commission has ruled.

The Oncall Group Australia out-of-home coordinator had applied to the FWC to deal with a dismissal dispute, claiming the employer had contravened her workplace rights, but the employer objected on the basis that she hadn't been sacked.

The Commission heard that in October 2021, the employee complained to HR that she was being targeted, bullied and harassed by her manager.

The people and culture executive manager met with the employee to discuss her complaint, and subsequently gave her three options: withdraw the allegations; pursue her complaint after giving it more thought; or resign...
