HR manager's "welfare check" criticised

An HR manager took the "first opportunity" to dismiss an employee who raised workplace bullying allegations, a court has ruled in adverse action proceedings.

The Della Rosa Fresh Foods production worker claimed the employer, HR manager and production manager breached the Fair Work Act in dismissing her because she had, or proposed to exercise, a workplace right.

She told the Federal Circuit Court that in March 2020, the production manager said in an aggressive and threatening manner that if she didn't work overtime on a Saturday then he would make life very difficult for her. She said it was hard for her to perform overtime because of childcare commitments, but eventually worked as required...
