An employer victimised a complaining employee by preventing her from returning to work after a psych injury, despite her full capacity, a commission has ruled in ordering $36k in damages.
In 2015, the NSW Department of Communities and Justice employee complained to the State Anti-Discrimination Board that she was being prevented from returning from depression-related sick leave because she'd made a sexual harassment complaint against a senior leader.
The NSW Civil and Administrative Appeals Tribunal subsequently awarded the employee $20k in general damages for victimisation.
