Horseplay "badly backfired", but mitigating factors were "compelling"

A commission has found an employee's attempt to "gee up" a subordinate was not trivial and couldn't go unpunished, even though he wasn't trying to be malicious or aggressive.

Queensland Industrial Relations Commissioner John Dwyer said the supply supervisor's "very misguided" attempt at humour "badly backfired", and he shouldn't have assumed the subordinate would understand his intentions.

In March this year, Queensland Health substantiated an allegation that the employee breached its code of conduct when he verbally and/or physically abused the subordinate in November 2021, and it said it was considering terminating his employment...
