Being under pressure and under-resourced did not "even remotely excuse" an employee's wilful and deliberate misconduct, the Fair Work Commission has found in rejecting his unfair dismissal application.

The Catholic Homes Incorporated multi-skilled care worker was dismissed in June 2022 for elder abuse.

Two student nurses had reported the employee's behaviour after allegedly witnessing multiple incidents of unreasonable physical force, mistreatment and neglect against two residents.
