"High-stress workplace" is no excuse for abuse: FWC

Being under pressure and under-resourced did not "even remotely excuse" an employee's wilful and deliberate misconduct, the Fair Work Commission has found in rejecting his unfair dismissal application.

The Catholic Homes Incorporated multi-skilled care worker was dismissed in June 2022 for elder abuse.

Two student nurses had reported the employee's behaviour after allegedly witnessing multiple incidents of unreasonable physical force, mistreatment and neglect against two residents. They claimed he had: yelled at a male resident to wake him up and used unreasonable force to move him during an incontinence aid change, which caused him pain; failed to gain consent from a female resident prior to undressing her for an incontinence aid change...
