"Heavy" enforcement on positive duty only where collaboration fails: AHRC

"Naming and shaming" employers that breach the positive duty to prevent workplace s-xual harassment is an option for the AHRC, but its primary goal is collaboration, according to S-x Discrimination Commissioner Anna Cody.

Asked whether it would take an approach similar to the Fair Work Ombudsman in publicly outing employers for non-compliance, Commissioner Cody says the Commission will "very much try and work with an employer or PCBU in the first instance".

"It's only if that fails that we would then go on to the more, sort of 'heavy' compliance approach..."
