Harassment claim not "fanciful" despite texts revealing "some kind of" relationship

An employee has been cleared to pursue a s-xual harassment claim against her former CEO and employer, despite the latter arguing she had welcomed the alleged behaviour.

Federal Court Justice Michael Feutrill said the employee's claims would "face significant headwinds", but they were still "reasonably arguable and not fanciful".

In January 2020, the St Ives Group employee complained of unlawful discrimination to the Australian Human Rights Commission, alleging the CEO (who was also her manager) sexually harassed her in 2015.

She also claimed she was subjected to unfavourable employment conditions, and then later sacked, due to her sex, her mental disability and/or because she'd complained about the CEO's conduct...
