Failing to suspend manager during investigation foils dismissal defence

An employer's failure to suspend a manager "at any time" during a 10-month investigation into aggressive conduct allegations has undermined its decision to dismiss him.

Gold Coast Hospital and Health Service sacked the service and data manager in October 2021, after finding he had breached its code of conduct during the Golden Gala Awards in December the year before, when he failed to treat a colleague and a member of the public with courtesy and respect.
