Expressing 'sincere' opinions about performance wasn't bullying

Accusing a long-serving employee of being "incapable" of performing his role and requiring him to work in the office more than others wasn't bullying, the Fair Work Commission has found.

The Commission refused to grant the Yarra City Council employee a stop-bullying order, finding none of the employer's conduct, nor that of its infrastructure manager, was unreasonable.

The employee claimed the manager yelled at him in front of others on two separate occasions, accusing him of making mistakes but without giving further details; he was also required to attend the office five days a week while colleagues were allowed to work two days from home.

He also alleged the manager removed him from a project, on the misconceived basis he was "incapable" of performing duties he'd been doing for 25 years "to the required standard"...
