An HR manager and other superiors caused an employee's psychological injury when they either ignored or failed to properly investigate her bullying and harassment complaints, a commission has ruled.
NSW Personal Injury Commission Member Karen Garner said the employer's attitude towards the employee was "typified" in a superior's email, which stated her allegations were "all a smoke screen" and that she hadn't been bullied, but rather had "a great strategy to ensure she gets what she wants".
"[This] demonstrated a cynical and hostile attitude to the [employee's] grievances being reasonable and demonstrated no effort to impartially deal with [her] ongoing complaints in accordance with the [employer's] Code of Conduct," she said...
