Employer's patience with 'disrespectful' worker had 'worn thin'

The Fair Work Commission has found a worker did not agree to end her employment and therefore was entitled to make a general protections claim, ruling her employer had grown intolerant of her "lack of obeisance" and sacked her.

The CJ Onetree hairdresser made a general protections application involving dismissal, but the employer objected on the basis that both parties had mutually agreed to end the working relationship.

The employee told the Commission that in March this year, she texted her manager to enquire about her personal leave entitlements, as she was feeling unwell and wanted to take time off work...
