Employer liable for "targeted" worker's psych injury

An employer has failed to prove an employee with a history of "troubling disorders" wasn't entitled to compensation for a psychological injury because its numerous management actions against him were reasonable.

The LWB Disability Services South Limited support worker claimed he was exposed to unsafe practices, unfair treatment and intimidation at work in 2019, and sought compensation and medical expenses, but the employer denied liability.

The NSW Personal Injury Commission heard that in mid-2018, the employee started the process of medically transitioning from female to male, which included hormone replacement therapy.

There was also evidence he had previously been diagnosed with borderline personality disorder, complex post-traumatic stress disorder, depression, and gender dysphoria, and that he had a criminal record related to cannabis possession...
