Employer didn't foster "culture of bullying": FWC

A worker's belief that managers and HR officers had bullied him was "largely based on speculation and suspicion", not evidence, although some of their actions were "not ideal", the Fair Work Commission has found.

The Receivables People Solutions customer relationship officer sought stop-bullying orders, claiming six senior managers and HR officers had bullied him individually and as a "gang" over the past four years.

He said the employer fostered an "organisational culture of bullying", which included managers and HR officers: not responding to or providing delayed responses to his workplace complaints; victimising him; lying to him; and misleading him.

The employer, however, alleged its conduct was reasonable management action carried out in a reasonable manner, and that there was evidence the employee himself had bullied other staff, particularly its HR business partner...
