Employee wins appeal over 'extremely inadequate' harassment damages

An employee who was subjected to "serious and repeated" harassment by her manager is entitled to more than the $10k in damages she was originally awarded, a court has ruled on appeal.

In March last year, the Gumboots Australia employee won her sexual harassment case against the manager, after the Victorian Civil and Administrative Tribunal found he had: slapped her on the buttocks on three occasions; made "vulgar" comments about her body; and tickled her while they were alone at work.

Senior Member Susan Burdon-Smith found all of the conduct, which occurred between August 2019 and January 2020, was unwelcome and caused the employee stress and anxiety, and she awarded her $10k in general damages...
