Employee voluntarily resigned from "horrifying" workplace

An employee who claimed he had no choice but to quit after being placed on repeated performance improvement plans has lost his unfair dismissal claim, with the Fair Work Commission finding his employer took "reasonable steps" to support him.

The administrative officer resigned from his position at Cavalry John James Hospital in May this year after he was given his third PIP.

He subsequently claimed he was constructively dismissed, but the employer objected on the basis he had voluntarily left his employment.

The Commission heard the employee had received PIPs in November and December 2022 due to issues with data entry, appropriate and safe use of equipment, and his level of service to patients...
