Employee sacked after "pattern of poor behaviour" wins reinstatement

An employer criticised for failing to undertake "even the most basic level of investigative analysis" has been ordered to reinstate an employee it sacked for misconduct.

In March this year, Opal Packaging Australia dismissed the machine operator, who it had employed since 1994, after an investigation substantiated allegations he'd breached its 'lock out tag out' (LOTO) procedure.

The employee claimed unfair dismissal, arguing he had locked out the relevant sections of the machine he had been working on, and that a supervisor who confronted him about working unsafely failed to confirm he had done so...
