Employee's "plea for action" was misinterpreted as aggression: FWC

An employee did "exactly what he should have done" when a colleague threatened to fight him several times, the Fair Work Commission has found in awarding him compensation for unfair dismissal.

The Turners Civil employee told the Commission that in the six months preceding his dismissal, a colleague had tried to fight him on three separate occasions, and he'd removed himself from the situations and reported the incidents.

The third incident occurred in December last year, when the pair were off-site at a farm. The colleague approached the employee from behind, calling him a "c-nt" and suggesting they "fight now"...
