"Emotional" response to performance concerns wasn't a resignation

A manager's "performance discussion" with an employee was actually an "unsatisfactory exchange of views conducted in a cursory and excited manner", the Fair Work Commission has found in unfair dismissal proceedings.

On 6 February this year, the SAL HR Services warehouse store person arrived for work minutes after his 8am start time, prompting his "annoyed" manager to raise concerns about his lateness.

Shortly after, the manager and employee began discussing packing procedures, leading to a heated exchange during which both parties spoke with raised voices and pointed to each other and packages on a pallet...
