Dismissal unfair after mishandled probation, poor communication

A "deficit in clear communication" about remote-work expectations and protocols understandably frustrated an employee, the Fair Work Commission has ruled in upholding his unfair dismissal claim.

The Renfay Projects estimator was sacked in February this year over issues about his work ethic and failure to follow protocols.

The Commission heard that the day before his dismissal, the employee sent a message to the office group chat to say he'd be working from home that day. The HR manager contacted him to say he should have sought her permission first.

The employee responded that the director allowed staff to work from home without approval, provided they notify HR and their team...
