Disciplinary process "destabilised" employee's mental state

An employee who was threatened and assaulted by another worker has been awarded compensation for a psychological injury, after a commission found the employer's investigation into the incident was unreasonable.

NSW Personal Injury Commission Member John Isaksen found the employee's team leader pre-judged what had occurred and accepted the other worker's version of events, despite having no supporting evidence.

He noted the team leader could have escalated the disciplinary process to a senior leader or HR representative who had more experience dealing with such matters, and his failure to do so subjected the employee to an unfair and stressful situation, which caused his psychological injury...
