"Deceptive conduct" and D&A breaches warranted dismissal

An employer "rightly" sacked an employee who put its reputation at risk when she engaged in criminal conduct, the Fair Work Commission has found.

In September last year, the Kingaroy Freight Express back-up driver returned late to the depot, allegedly due to a large customer delivery.

Vehicle tracking data showed she had stopped at a property not on the assigned route, and the employer directed her not to make personal stops or depart from the route in future.

When the employee was again late from a delivery run a few weeks later, the employer found she had stopped at the same property three times since its direction...
