CEO who misled recruiters loses appeal over disciplinary action

A former CEO deliberately misled a recruitment panel when he failed to disclose that in a prior role he was found to have "knowingly engaged" in unconscionable conduct, a tribunal has ruled.

The Queensland Industrial Relations Commission was considering an appeal by a director with Queensland Health, against a disciplinary finding that he had deliberately withheld information while he was being recruited.

Specifically, the former Captain Cook College CEO had failed to disclose a Federal Court ruling against him, which followed ACCC accusations regarding the way the College enrolled students.

As part of a settlement with the ACCC in June 2020, the executive admitted that he was knowingly concerned in the College's system of unconscionable conduct.
