Bullying response was "inadequate", but worker didn't have to resign: FWC

An employer's response to workplace bullying "fell well short of adequate", but it gave an employee several reasonable alternatives to resignation, the Fair Work Commission has found.

The brewer for South Australian craft beer brewery, Smiling Samoyed, claimed she was forced to resign in December last year as a result of the employer's failure to properly respond to an incident involving a manager.

The Commission heard that earlier that month, the venue manager confronted the employee, yelling about her making a mess in the bar area. The employee denied she had done so and told the manager to calm down, but the manager lost her temper, started swearing, and demanded she clean it up.

The manager then picked up a glass of cordial and threw the liquid onto the floor near the employee's feet, before picking up a water bottle and squirting water onto the floor, stating "f-cking clean it up! How do you like it?"...
