"Brutally honest" employee was fairly sacked over negligence accusations

An employee who was sacked for accusing his employer of covering up its own negligence has lost his unfair dismissal claim, with the Fair Work Commission finding he jumped to "quick, ill-informed conclusions".

The personal care assistant had been employed by Opal HealthCare since August 2019 and worked at the Opal Mornington Bay Community Care Home until his dismissal on 5 December 2022.

He claimed his dismissal was unfair on the basis that he was sacked for breaching policies and procedures, yet "serious" workplace incidents he had reported were never sufficiently investigated...
