"Some reputational harm" not enough to justify dismissal: FWC

An employee who engaged in a loud and public argument while wearing her work uniform may have caused her employer "some reputational harm", but not enough to warrant her immediate dismissal, the Fair Work Commission has ruled.

Deputy President Nicholas Lake found the Historical Village Herberton employee was also not given a sufficient opportunity to respond to the allegations against her.

The Commission heard that in September last year, the employee and the manager of a local pub were involved in a confrontation over an incident that had occurred a couple of days earlier, when the publican asked the "visibly intoxicated" employee to remove three cans of alcohol she had brought into the premises...
