Restraints went further than protecting employer's interests

A manager's post-employment restraints were far tighter than what was necessary to protect an employer's interests, a court has ruled in denying it interim relief.

In December last year, the United Petroleum wholesale state manager resigned so he could take up an aviation sales manager position with IOR Services, which also operates in the petroleum products sector.

United Petroleum subsequently claimed this would breach the restraints in his employment contract, and applied for interim relief enforcing the terms...
