Remote worker unfairly dismissed after refusing to attend office

A remote worker was unfairly dismissed for refusing to accept changes to her position that would require her to perform her duties in the office, the Fair Work Commission has found.

The accounts assistant had worked for Simsai Construction Group since 2013 until her employment was terminated in October last year.

In unfair dismissal proceedings, the employee told the Commission she had originally accepted employment on the condition she work from home for 35 hours per week and only attend the office occasionally, as she had caring responsibilities.

The Commission heard that in June last year, the employer notified the employee it was considering changing its software and hiring an accountant, which could lead to her hours dropping to 20 per week. It also said her duties would be best performed in the office...
