Harassing worker wins appeal against "double compensation"

A Tasmanian Supreme Court full bench has halved an employee's compensation for sexual harassment, after finding a settlement sum should have been taken into account when assessing damages.

In December 2017, the Sanity assistant retail manager complained to the State Anti-Discrimination Commissioner that she had been sexually harassed by a Toll Transport delivery driver during his regular stock deliveries.

She also complained Toll Transport had failed to take the necessary steps to ensure the driver did not engage in discrimination or prohibited conduct.

The matter was referred to the Anti-Discrimination Tribunal, which found the driver's conduct, in making unwanted remarks with sexual connotations and slapping the employee on the bottom, amounted to harassment...
