Employer's separation proposal was an "offer", not a "demand"

An employer that offered an absent worker three weeks' pay to resign did not "force" him to do so, the Fair Work Commission has ruled.

Deputy President Alan Colman found the employee made his decision "freely", and not as the "probable result of the employer's conduct" as he claimed.

The sales consultant had been employed by Western Highway Investments' car dealership from July 2022 until April 2023. He became unwell in February 2023 and took personal leave, ultimately exhausting his entitlement...
