Employer had "little choice" but to sack unvaccinated worker

An employer sacked a worker "with as fair a process as it could" after she refused to get vaccinated against COVID-19, the Fair Work Commission has ruled in rejecting her unfair dismissal claim.

In mid-2021, after Queensland Health issued a 17 September deadline for all aged care workers to have their first COVID vaccination, DPG Services informed all staff of the mandate and sent at least seven further emails prior to 3 September.

Two days before the deadline, the employee told the employer that she didn't wish to have the vaccination; she considered the mandate unlawful and wanted it to reconsider its policy.

In response, the employer said it had to comply with the Government's mandate and if the employee refused it could no longer give her shifts...
