"Unethical" agent must now seek permission for every dismissal claim

A workplace advisory service that pocketed an employee's settlement and misled her about its 'no win no fee guarantee' can no longer represent workers without first seeking permission from a full bench of the Fair Work Commission.

Employee Dismissals has been the subject of multiple complaints from workers who paid for representation after being dismissed.

Most recently, the FWC found it gave an employee an "inadequate and inaccurate" description of the dismissal claim it ultimately lodged, and it "misleadingly" implied the Commission had the power to "reverse" a dismissal.

In that case, President Justice Adam Hatcher referred to the "problematic" conduct of Employee Dismissals in 30 other Commission matters, which he listed in his decision...
