A self-proclaimed anti-vaxxer "arguably" suffered discrimination on the basis of "social origin" when she was sacked for failing to meet a vaccination deadline, but the discrimination was not direct nor unlawful, the Fair Work Commission has found.
The St Vincent De Paul duty manager was dismissed last year after failing to comply with vaccination requirements or provide proof of a medical exemption.
The employee lodged an unfair dismissal claim and argued that she'd been subjected to unlawful discrimination on the grounds of her "social origin" as an "anti-vaxxer".
