Employer wasn't required to consult about requesting vaccination proof

Three employees have failed to prove an employer breached their enterprise agreement when failing to consult about its COVID vaccination requirements or offer them alternative work arrangements.

In October last year, Melbourne Archdiocese Catholic Schools asked two teachers and a learning support officer working at Caroline Chisholm Catholic College to provide confirmation of their COVID vaccination status, which was required as part of the Victorian Government's public health direction for school staff.

The employees responded that requesting private and sensitive medical information breached the Commonwealth Privacy Act, and that the employer was engaging in coercion to compel vaccination by placing them on leave without pay or long-service leave.

They subsequently applied to the FWC to deal with a dispute under their enterprise agreement...
