Employee who 'struggled with criticism' resigned by choice: FWC

An employee who struggled when criticised and resigned when summoned to a misconduct meeting was not constructively dismissed, the Fair Work Commission has found.

The PD Curran Plumbing employee told Fair Work Commissioner Bernie Riordan that a series of events in July and August last year were either intended to bring about her resignation, or at least had that result.

Specifically, she alleged that managers:

  • told a new employee to "crack the whip" at her, in her presence;
  • called her a "child" repeatedly;
  • insisted they saw her with her mask off, vaping in the office, even after she denied it;
  • called her a "f-cking liar" and a "f-cking child" who spoke nothing but "f-cking bullsh-it"; and
  • said words to the effect of, "now that you're off the phone you can go back to being your bogan self"...
